Welcome to Defense Base Act - Consultant LLC. These Terms and Conditions ("Terms") govern your use of our services, including our 24/7 PTSD Support, Lawyer Match, Therapist & Psychiatrist referrals, Settlement Guidance, and expert assistance with navigating your Defense Base Act (DBA) PTSD claims ("Services"). By using our Services, you agree to comply with and be bound by these Terms. Please read these Terms carefully. If you do not agree with these Terms, you may not access or use our Services.

1. Scope of Services

We offer the following Services:

  • PTSD Support Sessions: Professional mental health support for individuals dealing with PTSD related to their work as a contractor under the Defense Base Act.

  • Lawyer Match: Assistance in connecting clients with experienced legal professionals who specialize in Defense Base Act (DBA) PTSD claims.

  • Therapist & Psychiatrist Referral: Assistance in connecting with licensed psychiatrists and therapists who specialize in PTSD diagnosis and treatment.

  • Settlement Guidance: Expert consultation and assistance in navigating lump-sum settlements, ensuring you understand your legal rights and the settlement process.

  • Expert Team Assistance: A dedicated team of professionals providing comprehensive support through every stage of your claim, from paperwork to final settlement.

These services are available to clients 24/7, with ongoing support via phone, email, or online chat.

2. Eligibility and Registration

To use our Services, you must meet the following criteria:

  • You must be a contractor who worked overseas under the Defense Base Act (DBA) or a claimant eligible for PTSD-related claims under the DBA.

  • You must be at least 18 years of age and capable of entering into a legally binding agreement.

  • You must provide accurate, complete, and current information when registering for our Services.

By using our Services, you warrant that you meet these eligibility requirements.

3. User Responsibilities

By using our Services, you agree to:

  • Provide accurate information and complete the necessary paperwork when requested.

  • Do not use our Services for any unlawful purposes, including fraudulent or misleading actions.

  • Maintain the confidentiality of your account information and promptly notify us of any unauthorized use of your account.

  • Cooperate with our expert team and follow the guidance provided for your claim.

Failure to meet these responsibilities may result in the suspension or termination of your access to our Services.

4. Service Fees

We charge fees for some of our services, which are outlined below:

  • Free Consultation: We offer an initial consultation at no cost to help you understand your options and how we can support you with your DBA PTSD claim.

  • Administration Fee: If you decide to move forward with our services, a $50 administration fee is required upfront. This fee covers the initial administrative costs associated with processing your claim.

  • Success-Based Fee: We charge a 4% fee on the total settlement you receive, but only if your case results in a settlement. If no settlement is reached, you will not incur any costs for our service.

Payment Methods: Payments for applicable services can be made using major credit cards, debit cards, or other approved methods.

Refund Policy: Payments for Services are generally non-refundable, except where required by law. Refund requests may be considered on a case-by-case basis.

We reserve the right to modify our pricing or introduce new fees at any time. You will be notified of such changes in advance.

5. Privacy and Confidentiality

We take your privacy seriously and are committed to protecting your personal information. By using our Services, you consent to the collection, storage, and processing of your data in accordance with our Privacy Policy.

Data Collection: We may collect personal information necessary to provide our Services, such as contact details, medical history, and claim-related information.

Data Sharing: Your information will not be shared with third parties except as necessary to fulfill our Services (e.g., connecting you with a lawyer or therapist) or as required by law.

Confidentiality: We will take reasonable steps to protect your personal information from unauthorized disclosure. However, please note that confidentiality may be waived if disclosure is required by law or in connection with legal proceedings.

6. Limitations of Service

  • No Guarantee of Outcome: While we strive to provide expert guidance and assistance, we do not guarantee the outcome of any legal or settlement matter, including the final amount of any settlement or claim resolution.

  • Therapeutic Services: Our psychiatrist and therapy services are intended to support individuals dealing with PTSD. We do not provide psychiatric diagnoses or medical treatment, and you should consult with a licensed medical provider for any medical or mental health concerns.

  • Legal Advice: While we connect you with experienced legal professionals, our team is not authorized to practice law and does not provide formal legal representation.

  • Availability: While we provide 24/7 support, response times may vary, and we cannot guarantee immediate availability at all times.

​7. Disclaimers and Limitations of Liability

To the fullest extent permitted by law:

  • No Liability for Actions of Third Parties: We are not liable for any actions or omissions of the third-party professionals (lawyers, therapists, etc.) that you are connected with through our Services.

  • No Liability for Outcomes: We are not responsible for the results of your PTSD claim, legal matters, or settlement negotiations. Our Services are designed to provide guidance, but we cannot guarantee specific results.

  • Indemnity: You agree to indemnify and hold harmless Defense Base Act - Consultant LLC, its employees, contractors, and affiliates from any claims, damages, or expenses arising from your use of our Services, including any disputes with third-party professionals.

8. Termination

We reserve the right to terminate or suspend your access to our Services at our sole discretion, with or without notice, if you breach these Terms or engage in any conduct that we deem harmful to the operation or reputation of our Services.

Upon termination, you will no longer have access to any ongoing services or consultations. You may still be required to settle any outstanding fees for Services rendered prior to termination.

9. Dispute Resolution

In the event of a dispute or disagreement arising from or in connection with these Terms, you agree to resolve the matter through the following process:

  • Negotiation: Initially, the parties will attempt to resolve the dispute through informal negotiations.

  • Mediation: If the dispute is not resolved through negotiation, the parties agree to submit the matter to mediation with a neutral third-party mediator.

  • Arbitration: If mediation fails, the parties agree to resolve the dispute through binding arbitration under the rules of an Arbitration Organization in Sterling, Virginia.

You agree that the jurisdiction for any legal actions will be limited to Sterling, Virginia, and you waive any right to a jury trial.

 

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Virginia in Loudoun County, without regard to its conflict of law principles.

11. Modifications to Terms

We may update or modify these Terms at any time. Any changes will be effective upon posting to our website or notifying you directly. Continued use of our Services after any such modifications constitutes your acceptance of the updated Terms.
